Ohio has agreed to pay a central Ohio man $110,000 because a judge refused to release him from prison.

The man, Frank Davis, was convicted in 1999 when police found 3 pounds of cocaine in his home during a search. However, his conviction was overturned in appeals court due to the search warrant being defective.

Clark County Common Pleas Judge Douglas Rastatter refused to release Davis and was eventually forced to do so by the appeals court. Now the state will have to reimburse Davis for having him wrongfully incarcerated for 192 days.

The state’s Controlling Board is expected to vote Monday on the settlement.
